General Terms

Placing and paying for an order constitutes your agreement to follow and be bound by these Terms and Conditions.

Persons under the age of 18 are not permitted to make purchases from kesterhewcrawfordart.co.uk without prior agreement.

Definitions:

I am: Kester Hew Crawford trading under the same name (herein referred to as ‘Kester Hew Crawford, ‘I’, or ‘me’)

You are: A customer of Kester Hew Crawford (herein referred to as ‘you’ or ‘your’)

The contract between us

I must receive the entire payment for the goods that you have ordered before I can accept your order. Payment for the goods represents your offer to purchase the goods, which I will accept when the goods are dispatched. It is at this point only that a legally binding contract is created between us. Confirmation of receipt of your order by e-mail, does not guarantee the product sale.

Content accuracy

The specific details of product listings and descriptions provide information which should be noted. All information is given in good faith however I cannot accept liability for any mistakes or minor inaccuracies present within product descriptions.

Due to the limitations of photography colour reproduction and differences in computer screen display colour, the actual colour, shade or tone of any artwork may vary slightly from that shown in product photographs. I have made all efforts to represent products as accurately as possible however I cannot be held responsible for slight variations in actual colour. Product photographs are not shown at actual sizes unless stated.

Pricing

The prices payable for artworks that you order are detailed on my website at the specific time that you make your purchase. I reserve the right to advertise the same artworks elsewhere at different prices due to differing commission rates and / or special promotions.

Payment terms

I will accept payment for goods and services by PayPal and Stripe. Goods will be dispatched on orders that have been paid in full and once payments have been verified as valid and lawful. All prices advertised (unless converted using website currency conversion tools) are in Pound Sterling (£ / GBP). Kester Hew Crawford is not VAT registered and therefore VAT is not applicable to any quoted prices.

Delivery and Postage

I can accept no liability for the delay of orders due to circumstances beyond my control including delays as a result of postage / courier delays.

I cannot be held liable for any consequential loss resulting from delayed or lost parcels.

In the unlikely event of a parcel becoming lost / damaged, I and the courier / postal service must be informed immediately. In the case of a damaged parcel, photographic evidence will be requested to assist with compensation claims - this will be needed before any claim process can commence.

I am unable to begin a claim for a lost parcel until the eligibility timeframe as specified by the courier has elapsed, and the parcel is officially considered lost. I am unable to refund customers for lost parcels until I have successfully made a compensation claim to the courier.

Artworks will be dispatched to the address specified by you in your order. I cannot accept liability for any loss or damage to the goods once they have been delivered to you and risk of loss or damage to the goods passes to you upon delivery. You become the owner of the goods you ordered when they have been successfully delivered to you.           

Customs and Duties

Please note that all orders shipped outside of the UK and those sent to the Channel Islands may be subject to Import Duty / TAX / VAT which are applied once a shipment reaches your country.

I have no control over these charges and I am unable to predict what they may be. These charges are the responsibility of the customer as the importer and I will not be not responsible for the payment of these charges under any circumstances. Customs clearance charges and handling fees must also be paid for by the importer of the goods.

I cannot offer a refund for goods returned because the customer wishes to avoid paying customs duties.

When ordering from me outside of the UK, you are agreeing to pay any Import Duty / Tax / VAT which may be imposed by your country's government. If you refuse to pay any Import Duty / Tax / VAT imposed, thereby preventing delivery of your order, you will remain liable for the purchase price of the product(s) and any Import Duty / Tax / VAT or penalty imposed by your government.

Items sent overseas may be subject to random checks which may cause associated delays and additional charges. I am not responsible for delays or charges imposed by your countries government or other agencies.

Cancellation rights

Under the The Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 you have the right to cancel your order up to 14 days after the day on which you receive your order. You are not required to provide a reason for cancelling. However, I will need to be notified in writing as soon as you wish to cancel your contract.

If you have received the goods before you cancel your contract then you must send the goods back to me at your own cost and risk. If you cancel your contract but after I have processed your order for delivery, you should not unpack the order when it arrives. I will supply a printable return address label and instructions for return.  Cancellation returns must be sent at your own cost and risk as soon as possible. The goods must be in perfect and saleable condition on return.

Following notification that you wish to cancel your contract, any sum debited by me from your credit or debit card will be re-credited to you as soon as possible and within 30 days.

Cancellation by Kester Hew Crawford

I reserve the right not to process your order if one or more of the goods you ordered was listed at an incorrect price due to a pricing or typographical error. If I do not process your order under these circumstances, I will notify you by e-mail and will re-credit the sum deducted from your account by me as soon as possible, but no later than 30 days.

Online Tuition

Once a customer has purchased an online tutorial, I will contact the customer as soon as possible to arrange a mutually convenient time and date for the session. To avoid disappoint, customers you have specific scheduling commitments are advised to contact me before checking out on a tutorial to ensure I am available to provide tutorials when required.

Should you need cancel or postpone a pre–arranged online meeting, please do so at least 12 hours before the tutorial is due to begin. If a tutorial is cancelled within the 12 hours before the start time of the tutorial, I will only be able to refund 50% of the tutorial purchase price. If the lesson is cancelled within 2 hours of the tutorial start time, I reserve the right to retain 100% of the tutorial price.

I reserve the right to cancel and refund any online tutorials purchased, at my discretion.

By purchasing an online tutorial, you are agreeing to these terms.

Customer Data Protection

It is necessary for certain customer details to be used by me for the processing of orders and communicating with customers. The most commonly used data is; customer name, email address, postal address and telephone number. Data may also include details relating to payment methods.

Any personal information you give to me will always be processed in accordance with the UK Data Protection Act 2018. I will only use the personal information you provide to deliver the services you have requested, or for my lawful, disclosed purposes. I will not make your personal details available outside my company without your consent, unless obliged to by law.

General Liability

I do not accept liability for any typographical, clerical or other errors and/or omissions and reserve the right to add to, delete from, and modify any of the information found on the Kester Hew Crawford website and as published elsewhere at any time and without notice.

The contract between us shall be governed by the laws of England and Wales and any dispute between us will be resolved exclusively in the courts of England and Wales.

The instruction of an order is bound under the Consumer Rights Act 2015 and is made between mw and you as the purchaser. I do not endorse the resale of any product purchased from the Kester Hew Crawford website and will not enter into any discussion about an order with any persons other than the original purchaser.

I reserve the right to modify these terms and conditions at any time and you should check these terms for each purchase you make.
